1. General Provisions
1.1. This Privacy Policy (hereinafter referred to as the “Policy”) was developed by the individual entrepreneur Ushakova Anastasia Sergeevna, identification code (registration number): 3208012580, to explain the procedure for collecting, storing, using and other processing of Personal Data of individuals who have placed and/or confirmed an Order on the Site.
1.2. The Customer's consent to this Policy means the Customer's confirmation that he is aware of the procedure for collecting, storing, using and other processing of his Personal data and the Customer has given his consent to the Contractor to collect, store, use and other processing of his Personal data in accordance with the provisions of this Policy.1.3. This Policy shall enter into force from the moment of its posting on the Site. The Contractor reserves the right to unilaterally, without any special notice, make changes to this Policy at any time by posting a new version on the Site. Each new version of the Policy shall enter into force from the moment of its posting on the Site, canceling the validity of the previous version.
1.4. This Policy is an integral part of the Offer.
 

2. Definition of Terms
2.1. The term “Personal Data” in this Policy, including Section 1 “General Provisions”, means information about a specific Customer that allows identifying this Customer as an individual.
2.2. Other terms used in this Policy are interpreted in accordance with the Public Offer posted on the website at the link: https://www.flh-services.com, generally accepted interpretation and current legislation of Ukraine.


3. Personal data
3.1. When placing an Order on the Site, in the manner established by the Contractor, the Customer shall provide the Contractor with the following Personal data:
3.1.1. contact telephone number;
3.1.2. his/her surname and first name;
3.1.3. company name;
3.1.3. other information (comment), at the request of the Customer.
3.2. When confirming the Order, in the manner established by the Contractor, the Customer additionally transfers to the Contractor the data necessary for the provision of Services.
3.3. Provision of Personal data provided for in clause 3.1 of this Policy is mandatory for placing an Order on the Site. Provision of Personal data provided for in clause 3.2 of this Policy is mandatory for the provision/receipt of Services.
3.4. In addition to the Personal Data specified in clauses 3.1-3.2 of this Policy, the Contractor may also collect technical information, including data on the frequency of visits to the Site, the duration of use of the Site, the time and date of placing the Order, the Customer's IP address at the time of placing the Order, etc.
3.5. The Contractor does not receive, store or in any other way process the Customer's bank card data used for payment.3.6. The Contractor does not collect or otherwise process Personal Data about racial or ethnic origin, political, religious or philosophical beliefs, membership in political parties and trade unions, criminal convictions, as well as data relating to health, sex life, biometric or genetic data.


4. Purposes of processing Personal Data
4.1. The Contractor stores and processes Personal Data for the purpose of:
4.1.1. ensuring the possibility of processing and fulfilling Orders, including the provision, registration and performance of Services, as well as communication with the Customer;
4.1.2. providing effective customer support to the Customer, responding to the Customer's requests in accordance with the current legislation of Ukraine, resolving problems and informing about the Services, changing the characteristics of the Services, etc.;
4.1.3. providing a personalized experience for the Customer, including an individual approach to the provision of Services in accordance with the Customer's wishes, as well as providing recommendations on the choice of Services;
4.1.4. sending information, marketing, advertising messages and offers that may be potentially interesting to the Customer, using the means of communication provided by the Customer;
4.1.5. receiving feedback from the Customer;4.1.6. conducting statistical and other research based on depersonalized data;
4.1.7. ensuring the security and confidentiality of Personal Data;
4.1.8. fulfilling its legal obligations and protecting its legitimate interests.
 

5. Storage of Personal Data
5.1. Personal data is stored in a personal data database owned by the Contractor. Personal data is stored for the period necessary to achieve the processing purposes disclosed in clause 4.1 of this Privacy Policy, as well as for 3 (three) years after termination of the Agreement.


6. Customer's Rights in Matters of Personal Data Protection
6.1. In accordance with the Law of Ukraine "On Personal Data Protection", the Customer has the right to:
6.1.1. know about the sources of collection, location of their Personal Data, purpose of their processing, location of the Contractor, except for cases established by law;
6.1.2. to receive information about the conditions for providing access to Personal Data, in particular information about third parties to whom his Personal Data is transferred;
6.1.3. to access his Personal Data;
6.1.4. to receive no later than thirty calendar days from the date of receipt of the request, except in cases provided for by law, a response on whether his Personal Data is being processed, as well as to receive the content of such Personal Data;
6.1.5. submit a reasoned request to the Contractor to object to the processing of their Personal Data;
6.1.6. submit a reasoned request to the Contractor to change or delete their Personal Data if these data are processed illegally or are inaccurate;
6.1.7. to protect their Personal Data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision, as well as to protect against the provision of information that is unreliable or defamatory of the honor, dignity and business reputation of an individual;
6.1.8. to file complaints about the processing of their Personal Data with the Commissioner or to the court;
6.1.9. to apply legal remedies in case of violation of the legislation on the protection of personal data;
6.1.10. to make reservations regarding the restriction of the right to process their Personal Data when providing consent;
6.1.11. to withdraw consent to the processing of Personal Data;
6.1.12. to know the mechanism of automatic processing of Personal Data;
6.1.13. to be protected against an automated decision that has legal consequences for him.


7. Protection of Personal Data
7.1. The Contractor shall take the necessary technical and organizational information security measures to protect Personal Data from accidental loss or destruction, from unlawful processing, including unlawful destruction or access to Personal Data. At the same time, despite all efforts, the Contractor cannot guarantee absolute protection from any threats related to the protection of Personal Data in the event of factors beyond the Contractor's control.7.2. The Contractor guarantees the fulfillment of its obligations to protect Personal Data from accidental loss or destruction, from unlawful processing, including unlawful destruction or access to Personal Data, within the limits of its responsibility and influence.


8. Transfer of Personal Data to third parties
8.1. The Contractor undertakes not to transfer Personal Data to third parties, except in cases where such transfer is required by law, at the request of the Customer itself, or in other cases where it is necessary for the purposes disclosed in clause 4.1 of this Policy, in compliance with the "principle of purpose limitation". The Customer agrees that the Contractor has the right to transfer the Customer's Personal Data to third parties for the purpose of no more than the fulfillment of a specific Order.
8.2. The Contractor's obligations to comply with the confidentiality and protection regime do not apply to the disclosure of Personal Data in the following cases:
8.2.1. the information was disclosed publicly by the Customer itself;
8.2.2. the information was disclosed to a state body at its request and the authority of this body to receive such information is determined by applicable law;
8.2.3. the information is disclosed on the basis of a court decision that has entered into legal force, to the extent necessary to execute such decision;
8.2.4. the information is permitted to be disclosed with the written consent of the Customer;
8.2.5. the information is disclosed in connection with the direct performance by the Contractor of its obligations stipulated by this Privacy Policy, the Offer and/or the current legislation of Ukraine.8.3. The Contractor agrees that the confidentiality of data transmitted via the Internet is not guaranteed and in the event that access to this data is obtained by third parties outside the area of ​​technical means of communication under the control of the Contractor, the Contractor shall not bear any liability, including, but not limited to, for damage caused by such access.


9. Other conditions
9.1. The Contractor is not liable for any harm or loss suffered by the Customer or third parties as a result of a misunderstanding or misunderstanding of the terms of this Policy. Until the terms of this Policy are accepted, any person has the right to contact the Contractor for clarification of the provisions of the Policy.9.2. In the event that any part of this Policy is held invalid, the remaining parts shall remain in full force and effect. The Customer's waiver of any provision or condition of this Policy or any breach thereof shall not invalidate such provision or condition.
